Information for your Estate Planning

A Will comes into effect upon your death. It helps to ensure your Estate passes to the people or organisations that you want, in the manner that will be most beneficial to them.

You can provide us with all the details we need to complete your Will from the comfort of your own lounge room with our fast and straightforward online process. To assist us in preparing for our discussion with you about your estate planning, please complete the details in this form, as might be applicable to you.  If you are unsure about any questions, you can skip them and we can discuss those questions with you later.

Your details

You can complete this form together as a couple. However, if there are significant differences in your assets, holdings and/or wishes, it may be better to complete this form twice.

Please list all of your children (including adult children), whether or not you intend to include them as
beneficiaries. Under Victorian law, certain family members can contest a Will, so knowing your full
family situation helps us to ensure your Will is drafted effectively.

ASSETS

List each asset you own, either on your own or jointly. In the Description column, a few words is enough — for property, say whether it's land, a business or your home; for bank accounts, the bank and account name; for shares, super or trusts, just the name.

An item or resource that you own or control with a monetary value

Whether the asset is owned by one person or more, equally or unequally

Provide address for physical items. Otherwise leave blank.

Please Note:

1) Superannuation and Life Assurance do not usually form part of an estate and are not subject to the provisions of your Will unless you nominate your estate as the beneficiary. Please ensure that you have advised any Trustee of such Funds in writing as to how you would like the proceeds of such policies distributed upon your death.

2) Jointly owned assets (unless held as Tenants in Common) do not form part of your estate and are not subject to the provisions of your Will, as the survivor automatically becomes the sole owner of such assets upon your death

LIABILITIES

List each debt or liability you have, either on your own or jointly. In the Description column, a few words is enough — for loans and credit cards, the bank or lender; for guarantees, who it's for and what it covers.

EXECUTOR(S)

You need to nominate a person to be executor.  You may, if you wish, appoint more than one person to act jointly as your executors (maximum of 4 individuals). An executor is the person entrusted with the significant responsibility of administering your estate by selling or transferring assets, paying liabilities and distributing the estate in accordance with your Will.

A substitute executor steps in if your executor is unable or unwilling to act.

BENEFICIARIES

Beneficiaries are the people or organisations who receive something under your Will. If you have a spouse or partner, most people leave the bulk of their estate to them, but you can also make specific gifts to others. You don't need to have everything worked out — just tell us your current thinking and we'll go through the details together.

List each item and who should receive it in the table below.
